AFTER FILING

When is the PERM stage complete?

    FILED

    The employer files ETA-9089

    The filing date generally becomes the PERM case’s Priority Date, and the case enters DOL’s review queue.

  2. 02
    IN QUEUE

    Wait for Analyst Review

    DOL reviews cases as the queue advances. The published average is a planning reference, not a fixed deadline for every case.

  3. 03
    UNDER REVIEW

    DOL reviews the application

    Analyst Review may end in certification or denial. Some cases enter Audit Review first.

  4. 04
    STAGE COMPLETE

    Prepare Form I-140 after certification

    After certification, the employer and attorney prepare Form I-140 and confirm filing within the PERM certification’s 180-day validity period.

If the case enters audit

The case moves into additional document review, so the standard Analyst Review estimate no longer applies.

The employer and attorney evaluate the next step based on the decision.
